NOTICE OF HEARING OF APPLICATION FOR VARIANCE RELIEF AND SITE PLAN APPROVAL

PLEASE TAKE NOTICE that on August 13, 2026, at 6:00 PM, prevailing time, at the Middle Township Municipal Building, located at Boyd and Mechanic Streets, Cape May Court House, NJ 08210, the Middle Township Zoning Board of Adjustment will hold a hearing on the application for development of the undersigned. Applicant seeks all required approvals and relief so as to permit:

The operation of a mobile food truck/trailer at the property located at 28 Indian Trail Road, Cape May Court House, NJ 08210 (the “Property”), a commercial plaza, on a full-time basis without changing location(s) of operation or period(s) of operation as required by the Middle Township Code § 176-5(L). The owner of the Property where the food truck/trailer will be sited and the tenant of the commercial unit adjacent to the location on the Property where the where the food truck/trailer will be sited have consented to this application.

To accomplish the same, applicant seeks the following relief from the following sections of the Township Code: § 176-5(L)(1) and (3), with § 176-5(L)(3)(b)(2) requiring that, “the mobile retail establishment unit may not remain at the longer than the duration indicated above, without the property owner obtaining site plan approval from the Middle Township Zoning Department. To the extent that variance relief is required in addition to the stated site plan approval, Applicant seeks a Flexible Variance (N.J.S.A. 40:55D-70c(2)) and a “D-1” use variance to permit the operation of a mobile-food vendor on site on a continual full-time basis.

A copy of the said application and accompanying documents will be on file with the Secretary of the Middle Township Zoning Board/Zoning Officer and may be inspected, during normal business hours, in the Middle Township Zoning Office, Middle Township Municipal Building, Boyd and Mechanic Streets, Cape May Court House, New Jersey, by all interested parties at least ten (10) days prior to the said hearing. Further, any interested party may appear in person or be attorney at said hearing and participate therein in accordance with the rules of the Middle Township Zoning Board. This notice is sent pursuant to the requirements of the Municipal Land Use Law.
