ORDINANCE NO. 1995
AN ORDINANCE AMENDING CHAPTER 252, FLOOD DAMAGE PREVENTION
BE IT ORDAINED, by the Council of the City of North Wildwood in the County of Cape May, State of New Jersey, as follows:
Section One. The portions of Ordinance No. 1719, adopted on August 1, 2017, that have been codified at §252-18A of the Code of the City of North Wildwood, are hereby amended and supplemented to the extent that §252-18A shall henceforth read as follows:
(1) All new construction and substantial improvement of any habitable building (as
defined in Section §252-1) located in flood hazard areas shall have the lowest floor,
including the basement, together with the attendant utilities (including all electrical,
heating, ventilating, air-conditioning and other service equipment) and sanitary
facilities, elevated at or above the Local Design Flood Elevation (DFE) as determined
in Subsection §252-14, or at a minimum BFE plus four feet of freeboard as defined
by this chapter, whichever is more restrictive, be in conformance with ASCE Chapter
7, and be confirmed by an Elevation Certificate.
(2) Require within any AO or AH Zone on the municipality’s DFIRM that all new
construction and substantial improvement of any residential structure shall have the
lowest floor, including the basement together with the attendant utilities and sanitary
facilities, elevated above the depth number specified in feet plus four feet above the
highest adjacent grade (at least five feet if no depth number is specified). And,
require adequate drainage paths
around structures on slopes to guide floodwaters around and away from proposed
structures.
(3) All foundations must be designed with flood resistant materials below DFE and
sealed by a registered design professional.
Section Two. The portions of Ordinance 1719 that have been codified in the Code of the City of North Wildwood at §252-18B(1), §252-18B(2) and §252-18B(3) are hereby amended to the extent that the phrase “plus two feet…” in §252-18B(1), §252-18B(2) and §252-18B(3) shall henceforth read “plus four feet…”
Section Three. The portion of Ordinance 1719 that has been codified in the Code of the City of North Wildwood at §252-18B(2) is hereby amended to the extent that the phrase “at least three feet…” in §252-18B(2) shall henceforth read “at least five feet…”
Section Four. The portion of Ordinance 1719 that has been codified in the Code of the City of North Wildwood at §252-18C(1)(d) is hereby amended to the extent that §252-18C(1)(d) shall henceforth read as follows:
(d) Be elevated on a permanent foundation using flood resistant materials, designed and
sealed by a registered design professional, such that the top of the lowest floor is at
or above the base flood elevation plus four feet or as required by ASCE/SEI, Table
2-1, whichever is more restrictive.
Section Five. The portions of Ordinance 1719 that have been codified in the Code of the City of North Wildwood at §252-19B(1)(a) and §252-19B(1)(b) are hereby amended to the extent that the phrase “two feet…” in §252-19B(1)(a) and §252-19B(1)(b) shall henceforth read “four feet…”
Section Six. If any portion of this Ordinance is determined to be invalid by a court of competent jurisdiction, that determination shall have no effect upon the remainder of this Ordinance, which shall remain valid and operable.
Section Seven. All Ordinances or parts of Ordinances inconsistent with this Ordinance, to the extent of such inconsistencies only, be and the same hereby are repealed.
Section Eight. This Ordinance shall take effect immediately upon final passage and publication as provided by law.

AN ORDINANCE AMENDING
CHAPTER 252, FLOOD DAMAGE PREVENTION
TAKE NOTICE that the foregoing Ordinance was introduced and passed on first reading at a regular meeting of the Mayor and Council of the City of North Wildwood, County of Cape May and State of New Jersey, on the 3rd day of February, 2026. A second reading, hearing and final consideration of the above Ordinance will be held on the 3rd day of March, 2026 at 10:00 AM in City Hall. The purpose of this Ordinance is to update the City Code regarding flood damage prevention in the City of North Wildwood in accordance with recent NJPACT and NJREAL regulations. Members of the general public who would like a copy of the Ordinance may obtain a copy, free of charge, at the office of the City Clerk in City Hall during normal business hours.
