YOU ARE HEREBY SUMMONED and required to serve upon Lamb McErlane, P.C., whose address is 1820 Chapel Avenue, Suite 300, Cherry Hill, New Jersey 08002, an Answer to the Complaint and Amended Complaint (if any), filed in a civil action in which Early Out Investment is Plaintiff and Charles E. Frates et al, are Defendants, pending in the Superior Court of New Jersey, Chancery Division, Cape May County, bearing Docket No. F. 000186-26, within thirty-five (35) days after February 11, 2026 exclusive of such date. If you fail to do so, Judgment by Default may be rendered against you for relief demanded in the Complaint and Amended Complaint (if any). You shall file your Answer and Proof of Service in duplicate with the Clerk of the Superior Court, Hughes Justice Complex, P.O. Box 971, Trenton, New Jersey 08625, in accordance with the Rules of Civil Practice and Procedure.
This action has been instituted for the purpose of foreclosing a Certificate of Tax Sale #22-00001, dated October 6, 2022, made by Terence Graff, Collector of Taxes of the City of Ocean City, State of New Jersey to Early Out Investment and recorded in the Cape May County Clerk’s office on December 15, 2022 in Book M6614 of Mortgages at Page 443; to recover possession of and concerning real estate located at 835 Pennlyn Place, Tax Lot 41 C1, Block 203, Ocean City, New Jersey.
IN ORDER TO PRESERVE ANY EQUITY THAT MAY EXIST IN THE PROPERTY BEING FORECLOSED, THE OWNER OR THE OWNER’S HEIRS, SHALL HAVE THE RIGHT TO DEMAND, BY WRITTEN REQUEST TO THE SUPERIOR COURT OF NEW JERSEY, NO LATER THAN 45 DAYS AFTER BEING SERVED WITH THE FORECLOSURE COMPLAINT AND BEFORE THE DATE THAT THE FINAL JUDGMENT IS ENTERED, THAT THE HOLDER OF THE TAX SALE CERTIFICATE, FORECLOSE THE RIGHT TO REDEEM IN THE SAME MANNER AS A MORTGAGE, THROUGH A JUDICIAL SALE THROUGH THE OFFICE OF THE COUNTY SHERIFF. IF THERE IS NO SUCH SURPLUS EQUITY, OR IF YOU DO NOT TIMELY REQUEST THE PROPERTY PROCEED TO A SHERIFF’S SALE, THE FORECLOSURE WILL CONTINUE AND UPON ENTRY OF THE FINAL JUDGMENT, TITLE TO THE PROPERTY SHALL VEST IN THE NAME OF THE PLAINTIFF OR ITS ASSIGNS.
You, Charles E. Frates are name a party defendant herein because you are the owner of the subject premises under foreclosure. Charles E. Frates died intestate on October 31, 2021. As a precaution and in case there are additional heirs at law, Plaintiff included in its action, Charles E. Frates, his heirs, devisees and personal representatives and his, their or any of their successors in right, title and interest for any interest they may have in the subject premises under foreclosure.
