PUBLIC NOTICE OF ELECTION
and REFERENDUM 2026
THE FIRE COMMISSIONERS OF
FIRE DISTRICT #3
UPPER TOWNSHIP,
COUNTY OF CAPE MAY, NEW JERSEY
Notice is hereby given to the legal voters of Fire District #3, in Upper Township, County of Cape May, that an election for the naming of Two (2) Commissioners for the Fire Commissioners of Fire District #3, in Upper Township, County of Cape May, will be held at the Marmora Fire House, 40 N. Old Tuckahoe Road, Marmora, New Jersey.
Date of Election: February 21, 2026
Time of Election: 2:00 p.m. to 9:00 p.m.
Voters will also be asked to vote YES or NO on the approval of the budget for the Fire Commissioners of Fire District #3, in Upper Township, County of Cape May, for the fiscal year 2026, which budget proposes an amount of $821,434.58 to be raised by taxation.
Voters will also be asked to vote YES or NO on the referendum approving the Fire Commissioners of Fire District #3, Upper Township, Cape May County, be authorized to purchase one (1) new fire apparatus, including all necessary equipment and accessories, at a total cost not to exceed Three Million Dollars ($3,000,000), and to finance such purchase by the issuance of bonds or notes (see N.J.S.A. 40A:2-1 et seq.), by lease-purchase or installment purchase agreement(s), by the use of available capital reserve funds, or by any combination thereof, as permitted by law.
Approval of this question will authorize the Fire Commissioners of Fire District #3, Upper Township, Cape May County, to acquire one (1) new tower ladder fire apparatus, together with all necessary equipment and accessories, to be used for fire protection and emergency response services within the Fire District.
The tower ladder fire apparatus will provide firefighters with the ability to safely access roofs, upper stories, and elevated areas of buildings from the ladder itself, reducing exposure to hazardous conditions and enhancing firefighter safety. The apparatus will support firefighting, rescue, ventilation, and other emergency operations from a secure and controlled platform.
The purchase is intended to replace the Fire District’s existing ladder apparatus, which is approaching the end of its useful service life. Replacement parts have become increasingly difficult to obtain, maintenance costs are expected to increase, and reliability may decline over time.
The total cost of the apparatus, including all related equipment and expenses, shall not exceed Three Million Dollars ($3,000,000). The Board of Fire Commissioners may finance the purchase through one or more methods permitted by law, including bonds or notes, lease-purchase or installment agreements, capital reserve funds, or any combination thereof. Approval of this question does not obligate the Fire District to use all authorized financing methods or to borrow the full authorized amount.
A “NO” vote means the Board will not be authorized to purchase the apparatus or appropriate funds for that purpose.
Only registered voters residing within Fire District #3 may vote in this election.
