LEGAL NOTICE

PLEASE TAKE NOTICE that the undersigned, X-Ella Realty LLC (the “Applicant”) has made application to the City of North Wildwood Planning Board (the “Board”) for a property commonly known as 223-225 East 18th Avenue, North Wildwood, New Jersey 08260, and more specifically designated as Lot 14 in Block 234 (the “Property”) on the Tax and Assessment Map of the City of North Wildwood, Cape May County, New Jersey, in order to install an inground swimming pool and associated site improvements at the Property which is currently developed with a recently renovated single-family dwelling, which previously existed as a 7-unit multifamily structure prior to recent renovations and a duplex structure (collectively, the “Project”). The Property is located in the R-1 zoning district. The Applicant is seeking the following:

1. Site plan approval, if required, pursuant to the Land Use Development Ordinance of the City of North Wildwood as well as the Municipal Land Use Law pursuant to N.J.S.A. 40:55D-46 and N.J.S.A. 40:55D-50;

2. Variance relief from the Land Use Development Ordinance of the City of North Wildwood and the Municipal Land Use Law pursuant to N.J.S.A. 40:55D-70(d) as follows:

a. Use variance for the expansion of a preexisting nonconforming use, which use is two principal dwelling structures on one lot. The project does not propose any expansion, enlargement or addition to either dwelling structure; however, the proposed swimming pool constitutes an expansion of the nonconforming use.

3. A Certificate of Nonconformity, or variance relief from the Land Use Development Ordinance of the City of North Wildwood and the Municipal Land Use Law pursuant to N.J.S.A. 40:55D-70(c) if required, as follows: 

a. Number of principal structures, where 1 principal structure per lot is permitted and 2 principal structures exist, which is an existing nonconforming condition and will not change as a result of the proposed project;

b. Front yard setback, if required, where 5 feet is required, 9 inches existed prior to the renovations and 1.18 feet now exists after the renovations, which is an existing nonconforming condition and will not change as a result of the proposed project;

c. Side yard setback on one side, if required, where 8 feet is required and 7 feet 5 ½ inches existed prior to the renovations and 7 feet 5 ¼ inches now exists after the renovations, which is an existing nonconforming condition and will not change as a result of the proposed project; and

d. Building height, if required, where 36 feet from base flood elevation 9.0′ is permitted and 41.3 feet from base flood elevation 9.0′ existed before and after the renovations, which will not change.

4. A Certificate of Nonconformity or any other bulk, dimensional and accessory variance relief or exceptions from the Land Use Development Ordinance of the City of North Wildwood and the Municipal Land Use Law pursuant to N.J.S.A. 40:55D-70(c) or N.J.S.A. 40:55D-70(d) which may be required, including, but not limited to, side yard setbacks, front yard setbacks, rear yard setbacks, setbacks to roof overhangs, building height, number of stories, building coverage, lot coverage, distance between structures, accessory structure setbacks, fencing, elevation of and distance to HVAC and/or pool equipment, contiguous raised curb, number, location or dimensions of parking at the Property in conjunction with the Residential Site Improvement Standards and curb cuts; and

5. The Applicant may also apply for such variance relief, exceptions, waivers, permits, approvals or licenses that are deemed necessary or appropriate by the Applicant or the Board, which may arise during the course of the hearing process.

The application is now on the calendar of the Board of the City of North Wildwood. The initial public hearing has been set for August 19, 2026 at 6:30 p.m. at City Hall located at 901 Atlantic Avenue, North Wildwood, Cape May County, New Jersey 08260. Any person affected by this application will have the opportunity to present any objections to the proposed development. All documents relating to this application may be inspected by the public Monday through Friday, between the hours of 9:00 a.m. and 4:00 p.m. in the Office of the Board of Planning/Zoning located at 901 Atlantic Avenue, North Wildwood, Cape May County, New Jersey 08260.
