LEGAL NOTICE

PLEASE TAKE NOTICE that the undersigned, Nicholas McGonigle and Jaqueline McGonigle (collectively, the “Applicant”), have made application to the Borough of West Wildwood Planning/Zoning Board (the “Board”) for property commonly known as 604 West Poplar Avenue, West Wildwood, New Jersey 08260 and also known as Lot 3 in Block 134, on the Tax and Assessment Map of the Borough of West Wildwood, Cape May County, New Jersey (the “Property”) in order to seek minor subdivision approval to create two newly described lots where one lot exists. The Property is located in the Residential (R-1) Zone. The Applicant is seeking the following relief:


1. Site plan approval, if required, pursuant to the Land Use Development Ordinance of the Borough of West Wildwood as well as the Municipal Land Use Law pursuant to N.J.S.A. 40:55D-46 and N.J.S.A. 40:55D-50;


2. Minor subdivision approval pursuant to the Land Use Development Ordinance of the Borough of West Wildwood as well as the Municipal Land Use Law pursuant to N.J.S.A. 40:55D-46 and N.J.S.A. 40:55D-50 in order to create two lots, which are proposed to be known as Lot 3.01 and Lot 3.02;

3. Variance relief from the Land Use Development Ordinance of the Borough of West Wildwood and the Municipal Land Use Law pursuant to N.J.S.A. 40:55D-70(c) as follows:

a. Side yard setback, where a minimum of 4 feet on each side is required, and proposed Lot 3.01 will provide for a building envelope that allows 4-foot setbacks on each side; however, one side yard setback to the existing dwelling on proposed Lot 3.02 will be 3.8 feet and the other side yard setback to the existing dwelling on proposed Lot 3.02 will be 11.8 feet.
b. Rear yard setback, where a minimum of 10 feet is required and proposed Lot 3.01 will provide for a building envelope that allows a 10-foot rear yard setback; however, a 9.6-foot rear yard setback to the existing dwelling on proposed Lot 3.02 exists and is proposed.

4. Any other bulk, dimensional and accessory variance relief or exceptions from the Land Use Development Ordinance of the Borough of West Wildwood and the Municipal Land Use Law pursuant to N.J.S.A. 40:55D-70(c) and N.J.S.A. 40:55D-70(d) which may be required, including, but not limited to, number of parking spaces, size of driveway, dimensions of parking spaces, curb cuts, side yard setbacks, front yard setbacks, rear yard setbacks, lot coverage, building coverage, building height, landscaping, building façade, accessory structures, setbacks to accessory structures, distance between buildings, building projections; and,

5. The Applicant may also apply for such variance relief, exceptions, waivers, permits, approvals or licenses that are deemed necessary or appropriate by the applicant or the Board, which may arise during the course of the hearing process.


The application is now on the calendar of the Board of the Borough of West Wildwood. The initial public hearing has been set for May 21, 2026, at 6:00 p.m., in the West Wildwood Borough Hall, 701 West Glenwood Avenue, West Wildwood, New Jersey 08260. Any person affected by this application will have the opportunity to present any objections to the proposed development. However, the Board reserves the right to exclude repetitious testimony. All documents relating to this application may be inspected by the public by appointment Monday through Friday, during normal business hours, with the Board Secretary in the Office of the Board, 701 West Glenwood Avenue, West Wildwood, New Jersey 08260.
