APPELLANT
STATEMENT IN SUPPORT OF USE VARIANCE APPLICATION
FOR LOTS 11.01, 12.02, AND 12.03 OF BLOCK 168
This is an application by P&R Properties and Design, LLC, for use variance approval for three lots located at 102 West 21st Avenue, 103 West 22nd Avenue, and 105 West 22nd Avenue. The lots are identified on the North Wildwood Municipal Tax Map as Block 168, Lots 11.01, 12.02, and 12.03. The properties in question are located in the Commercial Business District Zone (CBD).
The three lots in question were previously created as a result of major subdivision approved by the Planning Board by Resolution Number Z-23-11-1. Before then, the former use of the property was a commercial banking establishment. Since then, the structures on the property have been demolished. The former application resulting in Resolution Z-23-11-1 approved the creation of five (5) fully conforming 50 feet by 100 feet building lots for the future development of single family homes on each one. Lots 11.01, 12.02, and 12.03 are three of the five lots for which approval was granted. They currently consist of vacant land.
Although time extension approvals were previously granted by the Planning Board on two separate occasions to the former applicant, the approvals under such resolutions expired on December 3, 2024. Applicant now seeks to renew such approvals and requires use variance approval for the new construction of single family homes in the Commercial Business District.
The single family homes are proposed to be constructed and the plans have been designed to conform with the requirements of the R-2 Zoning District requirements and no bulk variances are required in connection with this application. For Lot 12.03 specifically, the plans for the construction of the single family home have been designed to conform with the terms of a Restrictive Deed that was recorded against the subject property as a condition of approval of Resolution Z-23-11-1. The design of Lot 12.03 conforms with the requirements of the terms of the Restrictive Deed which requires a 12-foot front yard setback, a 15-foot rear yard setback, and side yard setbacks of 4 feet and 12 feet respectively.
The application conforms in all respects. Applicant seeks any and all other variances, waivers, and approvals that may be necessary or required as a condition of approval for the construction of single family homes on each of the lots.
