PLEASE TAKE NOTICE that on Thursday, May 7, 2026, at 6:00 pm, a hearing will be held before the Zoning Board of Adjustment of the Lower Township Municipal Building meeting room, located at 2600 Bayshore Road, Villas, NJ 08251, to consider an application for variance relief pursuant to N.J.S.A. 40:55D-70(d) and N.J.S.A. 55D-70(c)(1) , on the premises located at 601 Wilson Avenue, North Cape May, New Jersey 08204.

The applicant seeks a use variance pursuant to N.J.S.A. 40:55D-70(d) to construct a two-story accessory dwelling unit for limited, occasional family use, which shall not be rented or used as a separate independent dwelling unit.

The Applicant also seeks bulk variance relief pursuant to N.J.S.A. 40:55D-70(c)(1) from the required 20-foot side and rear yard setback requirements to permit a setback of 4 feet for the proposed accessory structure.
The proposed accessory dwelling unit is not a permitted use in the R-3 Mainland Residential Zone and therefore requires a use variance pursuant to N.J.S.A. 40:55D-70(d) and Section 400-15 of the Code of the Township of Lower.
The Applicant also requests any and all other variances, waivers, or relief that may be deemed necessary by the Board in connection with this application.
Maps and other documents relating to this matter shall be available at least ten (10) days prior to the meeting date for inspection. The maps and documents relating to this application shall be available for public inspection at the Lower Township Municipal Building during normal business hours.

All parties to the hearing, including the public, must, no less than two days in advance of the meeting, provide the Board Secretary any additional documents or exhibits to be presented at the hearing. These additional documents and exhibits shall be individually labeled by the submitting party as an exhibit and the Board shall post the labeled exhibits prior to the meeting.
