NOTICE TO BIDDERS

FY2024 N.J.D.C.A SMALL CITIES PROGRAM – CREST PIER BATHROOM RENOVATIONS

Notice is hereby given that sealed proposals will be received by the Municipal Clerk, Borough of Wildwood Crest, Cape May County, New Jersey for the FY2024 N.J.D.C.A. Small Cities Program – Crest Pier Bathroom Renovations opened and read in public at the Borough of Wildwood Crest Municipal Building, 6101 Pacific Avenue, Wildwood Crest, Cape May County, New Jersey on May 6, 2026 at 11:30 a.m. prevailing time.

Bid Documents and Drawings for the proposed work, which have been prepared by DeBlasio & Associates, P.C., will be available at the office of said Engineer at 4701 New Jersey Avenue, Wildwood, New Jersey 08260 on April 15, 2026, and may be inspected by prospective bidders during business hours.

Minority and women owned businesses are welcome to bid this project. Federal and State wage rates must be adhered to. The highest of the two wage rates and fringe benefits are applicable.

Bid Documents and Drawings for the proposed work, which have been prepared by DeBlasio & Associates, P.C., are available at the office of said Engineer at 4701 New Jersey Avenue, Wildwood, New Jersey 08260, and may be inspected by prospective bidders during business hours.

Bidders will be furnished with a copy of the Bid Documents by request upon proper notice and payment of a non-refundable charge of $75.00 payable to DeBlasio & Associates, P.C., for reproduction and processing.

Proposals must be made on the standard Proposal Forms in the manner designated in the Bid Documents, must be enclosed in sealed envelopes bearing the name and address of the Bidder, and the name of the work on the outside addressed to Clerk, Borough of Wildwood Crest; and must be accompanied by a statement of Consent of Surety from a surety company authorized to do business in the State of New Jersey and acceptable to the City and either a Bid Bond, Certified or Cashier’s Check drawn to the order of the Borough of Wildwood Crest for not less than ten percent (10%) of the amount bid, except that the check need not exceed $20,000.00. The successful bidder is hereby notified that a performance bond for the full amount of the project is required.

The successful bidder will be required to execute a contract for the performance of the said work or the furnishing of said material or both, as the case may be, and a surety bond to be executed by a reliable surety company in a sum equal to the amount of the contract price for said work and/or material, guaranteeing the performance of the contract, which surety bond and contract shall be approved as to form and execution by the Borough Solicitor.

Federal Labor Standards require that Contractors and Sub-Contractors pay the higher of the State or Federal Wage Rates and fringe benefits in effect at the time the contract is signed.
All bids must be accompanied by a copy of the Contractors and all subcontractors registration certificates or applications for registration through the Federal System for Award Management (SAM). Upon approval of any pending applications for registration, the successful contractor and any subcontractors must submit copies of the approved registration certificates to the owner. SAM registration must be renewed and kept current during the course of the contract.
This federally funded infrastructure project is subject to the FY2023 (SFY2024) requirements of the Build America, Buy America Act (BABA) Act (Pub. L. No. 117-58, § 70901-70953, and 2 CFR Part 184), requiring all iron and steel used in the project be produced in the United States unless these materials are otherwise exempt or subject to an approved waiver. This requirement, known as the “Build America Preference (BAP),” applies to all federal financial assistance as defined in 2 CFR, § 200.1 in which funds are appropriated or otherwise made available and used for an infrastructure project, regardless of whether or not the project is funded through the Infrastructure Investment and Jobs Act (IIJA).

By submitting a bid, the Contractor certifies understanding and compliane with BABA requirements. Contractors and subcontractors shall provide necessary certifications, documentation, and verified information to support compliance or waiver requests throughout the project.

The bidders shall also be required to comply with the following:

A. Affirmative Action requirements (N.J.S.A. 10:5-31 et. seq.and N.J.A.C. 17:27).
B. The provisions of the New Jersey Prevailing Wage Act (N.J.S.A. 34:11-56.25 et. seq).
C. Americans with Disability Act of 1990, Title II (42 U.S.C. S121 01).
D. Worker and Community Right-to-Know Act (N.J.S.A. 34:5A-1).
E. Stockholder Disclosure Certification (P.L. 1977, C.33, N.J.S.A. 52:25-24.2).
F. Business Registration Certification (N.J.S.A. 52:32-44).
G. Public Works Contractors Registration (N.J.S.A. 34:11-56.48).
H. Consent of Surety (N.J.S.A. 40A:11-22).
I. Addendum Acknowledgement (N.J.S.A. 40A:11-23c. 1), 2) &3)).
J. Subcontractors List (N.J.S.A. 40A:11-16).

The award of the contract for this project will not be made until the necessary funds have been provided by the Borough of Wildwood Crest in a lawful manner. The Borough of Wildwood Crest reserves the right to consider the bids for sixty (60) days after the receipt of said bids. The Borough of Wildwood Crest also reserves the right to reject any or all bids or to waive any informalities in the best interest of the Borough of Wildwood Crest.

Each proposal and bid must be submitted in accordance with the terms of the aforesaid specifications, must be made on standard proposal forms contained in the bid documents and shall be delivered to the place and hour mentioned above.
