ORDINANCE NO. 2005

 

AN ORDINANCE AMENDING AND SUPPLEMENTING

ORDINANCE 1177, AS AMENDED

 

WHEREAS, Ordinance 1177, adopted May 19, 1994, has been codified in the Code of the City of North Wildwood as Chapter 276, Land Development; and

            WHEREAS, the City of North Wildwood’s Land Development Ordinance establishes specific Zoning Districts throughout the City which identify & specify permitted and prohibited uses, area & bulk requirements governing the construction of said uses, and requirements governing overall development within said districts; and

            WHEREAS, Ordinance 1952 enacted amendments to the Oceanside Zoning District & which repealed area & bulk regulations associated with hotel & motel uses, and which inadvertently resulted in the elimination of portions of the zoning table which established regulations associated with setbacks & building height requirements for permitted uses;

NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the City of North Wildwood, in the County of Cape May & State of New Jersey as follows:

Section One.  The portion of Ordinance 1177, as amended, that has been codified in the Code of the City of North Wildwood at §276-20.1(E) establishing Area and Bulk as well as Building Height regulations for permitted uses in the Oceanside Zone is hereby amended and supplemented so as to read as follows:

Maximum building height, single-family dwelling units (SFD); single-family  duplex dwelling units & triplex dwelling units

No building height shall exceed 36 feet in height from the base flood elevation (BFE) or three (3) stories, whichever is less, except that churches & schools shall not exceed 55 feet & except further as allowed in §276-47 of this Chapter.

 

The following structures may be erected above the heights prescribed by this section, but in no case shall the height of any of these appurtenances exceed a height equal to 10% more than the maximum height permitted for the particular use at issue:

 

Skylights, spires, cupolas, flagpoles, chimneys or similar structures

 

Cellular telephone antennas and/or associated equipment are expressly excluded from this provision

 









 


NOTES:


1

For the purposes of this section, setbacks shall be clear, unoccupied & unobstructed space measured at right angles between a lot line & the building envelope & shall extend from grade to sky, except for the permitted encroachments detailed in §276-20.1F herein, provided that such encroachments do not inhibit the free flow of pedestrian traffic.

Existing stairs & porches may be replaced with identical stairs & porches regardless of the setback requirements herein.

Zero (0) feet where adjoining structures are constructed with a common party wall, provided that access to the rear of each side of the structure is maintained via a service alley, and further provided that the parking requirements for each use are maintained via a shared parking or similar arrangement.

For renovations and/or additions to existing structures only, open porches, stairs and/or steps providing access to the 1st floor only shall be permitted to extend an additional three (3) feet into the required frontyard setback distance but must be set back a distance of four (4) feet from all street & property lines.  For new construction/reconstruction of open porches, stairs and/or steps, they must meet applicable zoning requirements & shall require a Zoning and/or Construction Permit, as applicable, in order to permit construction in this regard.

Regardless of whether front, side or rearyard.

 

 

Section Two.  If any portion of this Ordinance is determined to be invalid by a court of competent jurisdiction, that determination shall have no effect upon the remainder of this Ordinance, which shall remain valid & operable.

Section Three.  All Ordinances or parts of Ordinances inconsistent with this Ordinance, to the extent of such inconsistencies only, be & the same hereby are repealed.

Section Four.  This Ordinance shall take effect immediately upon final passage & publication as provided by Law.

AN ORDINANCE AMENDING AND SUPPLEMENTING

ORDINANCE 1177, AS AMENDED

TAKE NOTICE that the foregoing Ordinance was introduced and passed on first reading at a regular meeting of the Mayor and Council of the City of North Wildwood, County of Cape May and State of New Jersey, on the 17th day of March, 2026.  A second reading, hearing and final consideration of the above Ordinance will be held on the 7th day of April, 2026 at 10:00 AM in City Hall. The purpose of this Ordinance is to establish building heights in the Oceanside District of the Land Development Ordinance of the City of North Wildwood. Members of the general public who would like a copy of the Ordinance may obtain a copy, free of charge, at the office of the City Clerk in City Hall during normal business hours.
