NOTICE OF HEARING

TO WHOM IT MAY CONCERN:

In compliance with the pertinent provisions of the Cape May City Zoning and Land Development Ordinance, and the New Jersey Municipal Land Use Act, N.J.S.A. 40:55D-1 et seq., notice is hereby given that a written application has been filed by the undersigned with the Cape May City Planning Board for amended preliminary and final major site plan approval, “c” variance relief from minimum parking standards set forth in Section 525-49(C)4 to allow approximately 182 accessory parking spaces where approximately 277 parking spaces are required; and to excise a prior condition of approval as set forth below.  Applicant also seeks to extend this site plan approval for a period of four (4) years, together with any and all other variances or waivers the Board may reasonably require in the exercise of its discretion, and without further public notice.  By Resolution No. 07-09-2024:1 adopted on July 9, 2024, the Planning Board granted preliminary and final major site plan approval to the undersigned to allow for the construction, establishment and maintenance of renovations and an expansion to the existing 162 hotel room La Mer Beachfront Resort to include (1) demolition of approximately 51 existing hotel units and construction of 51 new modern hotel units in their place in a three story building for year-round transient occupancy, (2) demolition of the existing three story “Beach House at La Mer” with related improvements and construction of a proposed new four story event building with kitchen facilities for conferences, meetings, weddings and special events with approximately 202 seats and where alcoholic beverages will be served and (3) landscaping, lighting, identification signage, approximately 182 accessory parking spaces, stormwater management facilities and related site improvements.

The purpose of this application is to excise, remove and delete a condition of the approved site plan resolution prohibiting events from June 15 through Labor Day weekend.  With the elimination of this condition, the applicant would be permitted to conduct events year round without date/seasonal limitations.  Applicant further seeks variance relief from the minimum accessory parking requirement in the zoning ordinance.

Applicant also seeks an extension of final major site plan approval for one year pursuant to N.J.S.A. 40:55D-52(d) to July 9, 2027 and an additional three years pursuant to N.J.S.A. 40:55D-52(a) until July 9, 2030.

This application affects property shown as Lots 6-24 in Block 1146 on the Cape May City Tax Map, which property is located at 1317 Beach Avenue currently improved with the La Mer Beachfront Resort and Pier Horse Restaurant with related improvements, to remain.

            Public hearing on the above mentioned application has been scheduled for April 14, 2026, at 6:00 p.m., 643 Washington Street, Cape May, New Jersey, at which time and place any interested party (as defined in N.J.S.A. 40:55D-4) will have an opportunity to be heard.

All documents relating to this application are on file with the Board Secretary and may be inspected by the public from Monday through Friday 7:30 a.m. to 3:30 p.m. in the office of Construction/Zoning, at City Hall, 643 Washington Street, Cape May, New Jersey.
