Notice is hereby given that the following ordinance was introduced at a meeting of the Board of Commissioners of the Borough of Wildwood Crest on February 4, 2026 and passed on first reading, and the same was then ordered to be published according to law; and that such ordinance will be further considered for final passage at a meeting of the Board of Commissioners to be held at the Borough Hall in said Borough on February 18, 2026 at 5:00 P.M. prevailing time, or as soon thereafter as possible, at which time and place all persons interested will be given an opportunity to be heard concerning such ordinance.

ORDINANCE NO. 1478
ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 79 VEHICLES AND TRAFFIC PROHIBITING PARKING OF CERTAIN LARGE VEHICLES UPON THE STREETS OF THE BOROUGH

WHEREAS, the Board of Commissioners of the Borough of Wildwood Crest has determined that it is necessary and proper for good government, order and the protection of persons and property, and for the preservation of the public health, safety and welfare of the Borough and its inhabitants to amend and supplement Chapter 79 of the Code of the Borough of Wildwood Crest to prohibit the parking of large vehicles upon any street or public right-of-way at any time within the Borough of Wildwood Crest.

WHEREAS, the Board of Commissioners deems is necessary to regulate parking on public streets and rights-of-way to ensure public safety, maintain traffic flow, and preserve the residential character of neighborhoods, and the orderly regulation of its commercial business zones, and to further accommodate proposed street narrowing and road diets throughout the Borough.

NOW, THEREFORE, BE IT ORDAINED by the Board of Commissioners of the Borough of Wildwood Crest, in the County of Cape May, State of New Jersey, as follows:

Section 1. Ordinance Number 1316 adopted November 21, 2019 and codified in the Code of the Borough of Wildwood Crest at Section 79-8.3 is hereby amended as follows: (added language is underlined, deleted language is stricken)

§ 79-8.3. Parking of certain vehicles and attached trailers prohibited.

A. Parking prohibited. No person shall stop on, park, or stand a vehicle with an attached trailer, a house car or camp car as defined in chapter 75, box truck, or bus at any time upon the street or part thereof in the following areas:

Beginning at Rambler Road and extending to Atlanta Avenue on the
Westerly side of New Jersey Avenue.

Beginning at Rambler Road and extending to Miami Avenue on the Easterly side
of New Jersey Avenue.

B. No person shall park a vehicle, as defined in N.J.S.A. 39:1-1 et seq., with a gross vehicle weight rating (GVWR) of more than 10,000 pounds, including all box trucks and walk in or similar type trucks, buses, motor homes, house cars and camp cars, upon any street, alley or public right-of-way at any time within the Borough of Wildwood Crest. This prohibition shall not apply to:

(1) Vehicles actively engaged in loading or unloading of goods and materials.
(2) Municipal vehicles owned by the Borough or other governmental entities.
(3) Vehicles engaged in construction or repairs where such work is authorized by
the Borough.
(4) Pick-up trucks not to exceed 14,000 pounds GVWR.

C. B. The provisions of this section shall be enforced pursuant to the provisions of “The Parking Offenses Adjudication Act” N.J.S.A. 39:4-139.2.

D. C. Violations and penalties. Any person who commits a violation of this section shall upon conviction thereof for a first offense, pay a fine of not less than fifty ($50.00) dollars nor more than five hundred ($500.00) dollars and/or be imprisoned in the County Jail for a term not exceeding ninety (90) days. A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.

Section 2. The remainder of all other sections and subsections of the aforementioned ordinance not specifically amended by this Ordinance shall remain in full force and effect.

Section 3. All other ordinances in conflict with or inconsistent with this ordinance are hereby repealed to the extent of such inconsistency.

Section 4. If any portion of this ordinance is adjudged unconstitutional or invalid by a court of competent jurisdiction, such judgment shall not affect or invalidate the remainder of this ordinance, but shall be confined in its effect to the provision directly involved in the controversy in which such judgment shall have been rendered.

Section 5. This ordinance shall become effective twenty (20) days after final passage and advertisement thereof as required by law.
