CITY OF NORTH WILDWOOD PLANNING BOARD

RESOLUTION PB-05-2026

 

WHEREAS, pursuant to the New Jersey Municipal Land Use Law, specifically N.J.S.A. 40:55D-25 & 40:55D-28, Municipal Planning Boards are granted authority to adopt or amend a municipality’s Master Plan, or a component thereof; and

WHEREAS, in 2018, the City of North Wildwood Planning Board (Board) conducted a review & reexamination of the City’s Master Plan & Land Development Ordinance (Chapter 276-1 et. seq.), which was reduced to writing in the form of a report entitled “Master Plan Reexamination Report (2018 – Master Plan),” dated September 2018; and

            WHEREAS, over the course of the past several years, the Planning Board, at the direction of the North Wildwood City Council, has been directed to review proposed revisions to the Land Development Ordinance, Chapter 276-20.1 the Oceanside (OS) Zoning District as it relates to maximum building height, of the Code of the City of North Wildwood; and

            WHEREAS, at the Planning Board’s regularly scheduled meeting on March 18, 2026, the Planning Board discussed potential revisions to the City’s Land Development Ordinance, specifically § 276-20.1(E) of the Oceanside (OS) Zoning District, to adopt a building height regulation; and

            WHEREAS, proper notice was given to the persons and bodies as required by law, and the necessary publications were undertaken, and proofs with respect thereto have been filed; and

WHEREAS, at its March 18, 2026 regular meeting, the Planning Board discussed in detail the proposed revisions to adopt a maximum building height in the Oceanside (OS) Zoning District, and the Board unanimously agreed that it is appropriate to recommend that the Governing Body consider amending the Land Development Ordinance, specifically § 276-20.1(E), to permit such regulation;

            WHEREAS, the Board finds that such an adoption of maximum building height is consistent with sound planning principles, promotes resiliency & public safety, and advances the goals & objectives of the City’s Master Plan; and

            WHEREAS, at its duly noticed March 18, 2026 meeting, the Board discussed the adoption of said regulation & determined that it was appropriate to recommend that the North Wildwood City Council amend the Land Development Ordinance to adopt a maximum permitted building height for residential dwellings in the Oceanside (OS) Zoning District accordingly; and

            WHEREAS, proper notice was given to the persons & bodies as required by law, & the necessary publications were undertaken, & proofs with respect thereto have been filed;

            NOW, THEREFORE, BE IT RESOLVED by the Board of the City of North Wildwood as follows:

1.                  The following findings & conclusions are made:

a.                   All statements contained in the preamble to this Resolution are hereby incorporated by reference.

b.                  The City of North Wildwood Planning Board recommends that the City’s Land Development Ordinance, specifically:

§ 276-20.1(E), OS: Oceanside;

be adopted to reestablish maximum permitted building height for residential uses of 36 feet from BFE to top of the roof.

2.                  A copy of this Resolution shall be supplied to & filed with the City Clerk. 

3.                  The Planning Board Secretary shall cause notice of the adoption herein to be published in the official newspaper of the municipality & to provide lawful notice to persons & bodies as may be required by law.

4.                  This Resolution shall take effect immediately.

 

Resolution(s) memorializing the Board’s action was adopted at the March 18, 2026 Regular meeting.  Upon memorialization, said decision will be on file & available for inspection in the Office of the Planning Board Secretary, North Wildwood City Hall at 901 Atlantic Ave., North Wildwood, NJ.
