Notice is hereby given that the following ordinance was introduced at a meeting of the Board of Commissioners of the Borough of Wildwood Crest on August 19, 2026 and passed on first reading, and the same was then ordered to be published according to law; and that such ordinance will be further considered for final passage at a meeting of the Board of Commissioners to be held at the Borough Hall in said Borough on September 2, 2026 at 9:30 A.M. prevailing time, or as soon thereafter as possible, at which time and place all persons interested will be given an opportunity to be heard concerning such ordinance.

ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 75 TRAILERS, TEMPORARY DWELLINGS AND STRUCTURES, BOAT STORAGE, TO PROHIBIT BOAT TRAILERS AND CERTAIN STORAGE TRAILERS FROM PARKING ON THE STREETS OF THE BOROUGH OF WILDWOOD CREST
WHEREAS, the Board of Commissioners of the Borough of Wildwood Crest has determined that it is necessary and proper for good government, order and the protection of persons and property, and for the preservation of the public health, safety and welfare of the Borough and its inhabitants to amend Chapter 75 of the Code of the Borough of Wildwood Crest to prohibit the parking of motor vehicles with attached trailers and detached trailers from parking on the streets and public rights of way within the Borough of Wildwood Crest.
NOW, THEREFORE, BE IT ORDAINED by the Board of Commissioners of the Borough of Wildwood Crest, in the County of Cape May, New Jersey, as follows:
Section
1. Ordinance Number 1328,
adopted June 3, 202, that had been codified in the Code of the Borough of
Wildwood Crest, as Chapter 75, Section 75-3 Parking, storage of trailers
prohibited; exception, is hereby amended as follows (added language is underlined,
deleted language is stricken):
§ 75-1.Definition.
STORAGE TRAILER — Includes, but is not limited to, any trailer that is used for the storage of construction or demolition tools, materials or supplies for contractors engaged in construction or demolition activities, landscaping or grass cutting or for the storage of motor vehicles, whether a box trailer or flatbed trailer.
WATERCRAFT TRAILER — Includes, but is not limited to, any trailer that is designed or used for carrying, hauling or transporting powerboats, sailboats, personal watercraft or any other type of craft that is used in or on the water.
§ 75-3. Parking, storage of trailers prohibited; exception.
A. No person, firm or corporation shall park any detached trailer, camp car, house car, temporary structure on any street in the Borough of Wildwood Crest.
B. No person, firm or corporation shall store in the Borough of Wildwood Crest or on any private premises within the limits of the Borough of Wildwood Crest, any trailer, except for the purpose of repair and storage, provided that such trailer undergoing repairs or being stored shall be kept within a building; with the exception of the temporary purpose of loading or unloading therefrom.
C. Storage trailers. From May 15 through September 15 of each year, it shall be unlawful for any person, firm or corporation to park or permit to be parked a storage trailer, attached or unattached to a motor vehicle, upon any street within the Borough of Wildwood Crest.
D. Watercraft trailers. No person, firm or corporation shall park a motor vehicle with an attached trailer designed or used for the carrying, hauling or transporting powerboats, sailboats, personal watercraft or any other type of craft that is used in or on the water, on any street or public right of way within the Borough of Wildwood Crest, except that between the period of September 15 and the next following May 15 of each year, watercraft trailers may be parked upon the streets not in excess of five collective days (120 collective hours) subject to the following conditions: the owner of a watercraft trailer may park the watercraft trailer directly in front of, and immediately adjacent to, the curb or property line of any property that is owned by the owner of the watercraft trailer. If the watercraft trailer owner occupies the property as a tenant under a written lease then, prior to parking the watercraft trailer upon a street as permitted by this paragraph, the owner of the watercraft trailer shall have obtained the written consent of the property owner allowing the watercraft trailer to be parked directly in front of, and immediately adjacent to the curb or property line of the leased property. If the subject property has been developed with a multifamily residential dwelling, then prior to parking the watercraft trailer upon a street as permitted by this paragraph, the owner of the watercraft trailer shall have obtained the written consent from the association of owners responsible for administration of the multifamily dwelling complex and if no such association exists then from the owner of each unit in the multifamily dwelling which specifically authorizes the parking of such watercraft trailer to be parked directly in front of, and immediately adjacent to, the curb or property line of the subject property.
E. Exceptions.
1. landscapers and grass cutters, contractors for the storage of construction tools and material, at any time during the calendar year, and only during the period of time when the particular landscaper or grass cutter or contractor is actually engaged in work, are permitted to park a storage trailer in front of and adjacent to their work site during the hours between which construction is permitted to commence and end.
2. Trailers used for storage of motor vehicles may be parked on the street directly in front of, and immediately adjacent to, the curb or property line of any property that is owned or leased by the owner of the trailer, provided the trailer owner and motor vehicle associated with the trailer are participating in a municipal sponsored event or show. In such event, the trailer shall not be parked for longer than three (3) days, collectively.
E. During such periods of time when the parking of storage trailers upon the streets is permitted, to the extent possible, they shall be located on the work site for which the storage trailer is being used rather than on the street. In such cases where the only practical location for such storage trailer is on the street or public right of way, then the storage trailer shall be parked in front or within fifty (50 feet) of the work site or any property owned by the storage trailer owner and only during the period of time when the particular owner, contractor or storage trailer owner or operator is actually engaged in working on the project. All storage trailers shall be removed from the site, street or public right of way immediately following the completion of the construction, work, landscaping, grass cutting or other project on which a particular contractor or person was engaged. Trailers used by contractors for the storage of construction or demolition tools, materials or supplies may be parked detached from a motor vehicle in accordance with the restrictions set forth in this ordinance.
E. Not withstanding anything to the contrary herein, no trailer shall be permitted to be parked within 50 feet of any intersection at any time.
Section 2. The remainder of all other sections and subsections of the aforementioned ordinance not specifically amended by this Ordinance shall remain in full force and effect.
Section 3. All other ordinances in conflict with or inconsistent with this ordinance are hereby repealed to the extent of such inconsistency.
Section 4. If any portion of this ordinance is adjudged unconstitutional or invalid by a court of competent jurisdiction, such judgment shall not affect or invalidate the remainder of this ordinance, but shall be confined in its effect to the provision directly involved in the controversy in which such judgment shall have been rendered.
Section 5. This ordinance shall become effective twenty (20) days after final passage and advertisement thereof as required by law.
