ORDINANCE NO. 2014
AUTHORIZING LEASE OF REAL PROPERTY FOR USE AS A STAGING AREA FOR MATERIAL AND EQUIPMENT
WHEREAS, the Local Lands & Buildings Law, at N.J.S.A. 40A:12-4, provides that any municipality may acquire any real property or any interest or estate whatsoever therein; and
WHEREAS, N.J.S.A. 40A:12-5 provides that any municipality, by ordinance, may provide for the acquisition of any real property by lease; and
WHEREAS, the City of North Wildwood has entered into contracts for certain capital improvements and is in need of a staging area for material and equipment; and
WHEREAS, the City does not own any property that presently is unused and is suitable for use as a staging area for material and equipment and, therefore, the City has a need to acquire such property on a temporary basis for the duration of the construction projects; and
WHEREAS, the property that is identified on the Tax Map as Lot 1 in Block 82 is suitable for use as a staging area for material and equipment and the owner of that property has agreed to lease it to the City for consideration.
NOW, THEREFORE, BE IT ORDAINED, by the Council of the City of North Wildwood in the County of Cape May, State of New Jersey, as follows:
1) All of the statements of the preamble are incorporated herein by this reference thereto as though the same were set forth at length.
2) The Mayor and City Clerk be and they hereby are authorized, on behalf of the City of North Wildwood, to execute with the owner of Lot 1 in Block 82 a lease for the use of that property by the City of North Wildwood as a staging area for material and equipment for a term as described in a vacant real property lease which shall be annexed to and made part of this Ordinance.
3) The lease authorized by this Ordinance shall be for a determined amount of consideration and shall include such other terms and conditions as the Mayor, City Administrator, City Engineer and City Solicitor, in the reasonable exercise of their professional judgment, deem prudent and necessary.
4) If any portion of this Ordinance is determined to be invalid by a court of competent jurisdiction, that determination shall have no effect upon the remainder of this Ordinance, which shall remain valid and operable.
5) All Ordinances or parts of Ordinances inconsistent with this Ordinance, to the extent of such inconsistencies only, be and the same hereby are repealed.
6) This Ordinance shall take effect immediately upon final passage and publication as provided by law.

AUTHORIZING LEASE OF REAL PROPERTY FOR USE AS A STAGING AREA FOR MATERIAL AND EQUIPMENT
TAKE NOTICE that the foregoing Ordinance was introduced and passed on first reading at a regular meeting of the Mayor and Council of the City of North Wildwood, County of Cape May and State of New Jersey, on the 4th day of August, 2026. A second reading, hearing and final consideration of the above Ordinance will be held on the 18th day of August, 2026 at 10:00 AM in City Hall. The purpose of this Ordinance is to authorize the lease of a parcel on West 26th Avenue as a Staging Area for material and equipment. Members of the general public who would like a copy of the Ordinance may obtain a copy, free of charge, at the office of the City Clerk in City Hall during normal business hours.
