LEGAL NOTICE

PLEASE TAKE NOTICE that the undersigned, Daniel L. Sullivan and Barbara Sumple-Sullivan (the “Applicants”), have made application to the Stone Harbor Zoning Board of Adjustment (the “Board”) for a property commonly known as 9810 First Avenue, Stone Harbor, New Jersey, and more specifically designated as Lots 23.01, 24.01 and 25.01 in Block 98.01 (the “Property”) on the Tax and Assessment Map of Stone Harbor, Cape May County, New Jersey, in order to construct an elevator addition and associated improvements at the existing single-family dwelling at the undersized lot. The Property is located in the Residential A Zoning District. The Applicant is seeking the following:

 1. Preliminary and final site plan approval, if required, pursuant to the Land Use Development Ordinance of Stone Harbor as well as the Municipal Land Use Law pursuant to N.J.S.A. 40:55D-46 and N.J.S.A. 40:55D-50;

 2. Variance relief from the Land Use Development Ordinance of Stone Harbor and the Municipal Land Use Law pursuant to N.J.S.A. 40:55D-70(c) for the following:
  a. Minimum required lot area, where 6,600 square feet is required and 5,005 square feet exists, which is a preexisting nonconforming condition and will not change as a result of this proposed project;
  b. Minimum required lot frontage, where 60 feet is required and 55 feet exists, which is a preexisting nonconforming condition and will not change as a result of this proposed project;
  c. Maximum permitted building coverage, where 25% is permitted and 25.8% is proposed;
  d. Maximum permitted impervious lot coverage, where 55% is permitted and 67.3% is proposed; however, 70% was permitted at the time the existing dwelling was constructed and the existing level of impervious coverage is largely a function of the regulatory framework in place at the time of construction and is not being materially intensified by the proposed improvement, which is limited to a 42 square foot addition; and
  e. Maximum permitted lot coverage with semi-pervious coverage, where 70% is permitted and 0% semi-pervious coverage is proposed; however, this item was not applicable at the time the existing dwelling was constructed.

 3. The Applicant may also apply for such variances, exceptions, waivers, permits, approvals or licenses that are deemed necessary or appropriate by the Applicant or the Board, which may arise during the course of the hearing process, including, but not limited to variance relief or exceptions from the Land Use Development Ordinance of the Stone Harbor and the Municipal Land Use Law pursuant to N.J.S.A. 40:55D-70(c) or N.J.S.A. 40:55D-70(d) including, but not limited to side yard setbacks, front yard setbacks, rear yard setbacks, building height, building coverage, lot coverage, driveways, curb cuts, landscaping and parking spaces at the Property in conjunction with the Residential Site Improvement Standard and accessory structures.

The application is now on the calendar of the Zoning Board of Adjustment of Stone Harbor. The initial public hearing has been set for June 8, 2026 at 6:00 p.m. The hearing will be held in person at 9508 Second Avenue, Stone Harbor, New Jersey 08247. Any person affected by this application will have the opportunity to present any objections to the proposed development. However, the Board reserves the right to exclude repetitious testimony. All documents relating to this application may be inspected by the public beginning not less than ten (10) days prior to the hearing date in the office of the Zoning Officer, Municipal Building, located at 9508 Second Avenue, Stone Harbor, New Jersey 08247 during regular business hours. If you wish to make a statement or offer evidence concerning this application, you must appear in person at the hearing or through an attorney or agent. The Board cannot accept petitions or letters, and must rely on live testimony.
