ORDINANCE NO. 2009
AN ORDINANCE AUTHORIZING THE SALE AND TRANSFER OF REAL PROPERTY PURSUANT TO N.J.S.A. 40A:12-13 (b) (3)
WHEREAS, the City of North Wildwood is the owner of real property that is the subject of the Grantor a minor subdivision/lot line adjustment affecting Block 77, Lot 2 and Block 78, Lot 8 on the Tax Map of the City of North Wildwood, County of Cape May, State of New Jersey, resulting in the creation of Lot 2.01 in Block 77 and Lot 8.01 in Block 78, and the conveyance of a portion of Lot 2 in Block 77 to be added to the adjoining lot owned by the Anglesea Sunrise Condominium Association, the contiguous owner; and
WHEREAS, the subject newly created lots are less than the minimum size required for development under the municipal zoning ordinances that apply to the zone wherein the lot is situate and the lots are without any capital improvements thereon; and
WHEREAS, the subject lot is not needed for public use; and
WHEREAS, N.J.S.A.40A:12-13.2 provides that “Whenever any municipality intends to sell real property which is less than the minimum size required for development under the municipal zoning ordinance and is without any capital improvements thereon, it shall afford the owner or owners of any real property contiguous to such real property the right to prior refusal to purchase such land [;]” and
WHEREAS, the subject lots have one contiguous property owner as aforesaid; and
WHEREAS, N.J.S.A. 40A:12-13 provides: “Any….municipality may sell real property…not needed for public use…(b) At private sale, when authorized…by ordinance, in the case of a municipality, in the following cases:…(5) A sale to the owner of the real property contiguous to the real property being sold; provided that the property being sold is less than the minimum size required for development under the municipal zoning ordinance and is without any capital improvement thereon…” and an agreement of sale of the property not needed for public use has been entered into by the parties for the nominal sum of $1.00 and other good and fair consideration.
NOW, THEREFORE, BE IT ORDAINED by the Mayor ad Council of the City of North Wildwood, in the County of Cape May and State of New Jersey as follows:
Section One. The following real property, no longer being needed for public use, is to be sold to the contiguous property owner in accordance with the procedures mandated by N.J.S.A. 40A:12-13 (b) (3) at a price not less than the minimum price indicated herein:

Lot 2.01 in Block 77 and Lot 8.01 in Block 78,
And a portion of Lot 2 in Block 77 $ 1.00
Section Two. Upon the final adoption of this Ordinance, the Municipal Clerk is authorized and directed to record a Deed of Subdivision memorializing the Subdivision and transferring the property to the contiguous owner with the County Clerk’s Office.
Section Three. If any portion of this Ordinance is determined to be invalid by a court of competent jurisdiction, that determination shall have no effect upon the remainder of this Ordinance, which shall remain valid and operable.
Section Four. All Ordinances or parts of Ordinances inconsistent with this Ordinance, to the extent of such inconsistencies only, be and the same hereby are repealed.
Section Five. This Ordinance shall take effect immediately upon final passage and publication as provided by law.

AN ORDINANCE AUTHORIZING THE SALE AND TRANSFER OF REAL PROPERTY PURSUANT TO N.J.S.A. 40A:12-13 (b) (3)
TAKE NOTICE that the foregoing Ordinance was introduced and passed on first reading at a regular meeting of the Mayor and Council of the City of North Wildwood, County of Cape May and State of New Jersey, on the 19th day of May, 2026. A second reading, hearing and final consideration of the above Ordinance will be held on the 3rd day of June, 2026 at 10:00 AM in City Hall. The purpose of this Ordinance is to authorize the sale of a portion of property in the City of North Wildwood. Members of the general public who would like a copy of the Ordinance may obtain a copy, free of charge, at the office of the City Clerk in City Hall during normal business hours.
