TOWNSHIP OF LOWER ZONING BOARD OF ADJUSTMENT
NOTICE OF APPLICATION FOR DEVELOPMENT
PLEASE TAKE NOTICE that BRIAR, LLC (the “Applicant”) has applied to the Zoning Board of Adjustment of the Township of Lower, County of Cape May, State of New Jersey seeking preliminary and final major site plan approval as well as variance relief relating to the property known as 10100 Pacific Avenue, Lower Township, New Jersey 08260 (Block 727, Lots 1-5, 30). The subject property is located within Diamond Beach section of the Township of Lower and is within the General Business Zoning District (“GB”). The Applicant is requesting relief from the Board in order to demolish the existing improvements on the lot(s) and to develop new multifamily residential dwelling units. The proposed development contemplates construction of four (4) separate duplexes each containing two (2) townhouse style units, for a total of eight (8) residential units. The proposed development of the property contains sufficient off-street parking for all residential units. The Applicant is seeking variance relief pursuant to N.J.S.A. 40:55D-70(d)(1) of the NJ Municipal Land Use Law and Section 400-17 of the Township of Lower Land Development Ordinance pertaining to permitted uses in the GB Zoning District, where multi-family residential dwelling units are not a permitted use. Additionally, Applicant is seeking variance relief pursuant to N.J.S.A. 40:55-70(c)(1) and (2) of the NJ Municipal Land Use Law and Section 400-17 of the Township of Lower Land Use Development Ordinance pertaining to minimum front yard setback to building, minimum front yard setback to stairs, and maximum curb cuts per frontage. Applicant also requests any and all additional variances, approvals and/or waivers that the Board may deem necessary at the time of the hearing on this application.
PLEASE TAKE FURTHER NOTICE that a Public Hearing will be held before the Township of Lower Zoning Board of Adjustment on this Application on Thursday, June 4, 2026, at 6:00 PM at the Lower Township Municipal Building Meeting Room, located at 2600 Bayshore Road, Villas, New Jersey 08251. If you have any comments regarding this Application, you have the right to attend the meeting and be heard. At least ten (10) days prior to the aforesaid date, the Application, as well as all supporting plans and documents, will be on file in the office of the Board Secretary at the Lower Township Municipal Building, 2600 Bayshore Road, Villas, New Jersey 08251, and available for inspection during normal working hours on any weekday. This Notice is given pursuant to the provisions of N.J.S.A. 40:55D-1, et seq.
